CARTON COURIERS & LOGISTICS SERVICES

1. Definitions

• “Carton Couriers & Logistics Services” “We,” “Us”

• “Customer,” “Shipper,” “Consignee”-individuals who benefits from Carton Couriers & Logistics services.

• “Goods”-items being shipped by air or sea.

• “Services”-intangible actions offered by Carton Couriers & Logistics Services

• “Customs”-the government body that regulates Jamaica's imports and exports

• “Force Majeure”-clause that protects a company from unforeseen events beyond their control

2. Scope of Services

Our services include but not limited to:

• Ocean and air freight forwarding

• Consolidation and deconsolidation

• Warehousing and storage

• Inland transportation

• Package handling and delivery

3. Customer Obligations

Customers agree to:

• Provide accurate and complete shipment information

• Ensure goods are properly packed and labeled

• Comply with Jamaica Customs Agency (JCA) regulations

• Pay all applicable duties, taxes (including GCT), fees, and charges

• Ensure goods are lawful and not prohibited or restricted

4. Prohibited and Restricted Items:

• Illegal drugs and narcotics

• Firearms and ammunition (without permits)

• Hazardous materials (unless declared and approved)

• Counterfeit goods

• Perishable goods (unless specifically agreed)

Carton Couriers & Logistics Services may refuse, hold, or report prohibited shipments.

5. Customs Clearance

• All shipments are subject to inspection by Jamaica Customs

• Carton Couriers is not responsible for delays caused by Customs examinations

• Any penalties, seizures, or fines due to misdeclaration are the customer’s responsibility

6. Pricing, Fees, and Payment

Customers may be required to pay the following in accordance to nature of cargo

• Freight charges

• Handling and documentation fees

• Storage and demurrage charges

• Customs duties and taxes

• Late payment fees

Payment terms:

• Prepayment may be required

• Outstanding balances may result in goods being held or sold

• Prices may change without notice due to fuel surcharges, port fees, or currency fluctuations

7. Delivery and Transit Time

• Transit times are estimates only

• Delays may occur due to weather, port congestion, strikes, or Customs

• Carton Couriers does not guarantee delivery dates

8. Storage and Abandoned Goods

• Storage fees apply after the free storage period- 5 days

• Goods uncollected after a specified time may be deemed abandoned

• Carton Couriers may sell or dispose of abandoned goods to recover costs

9. Limitation of Liability

Carton Couriers & Logistics Services limits liability for:

• Liability limited to JMD value per pound or per shipment, unless higher value is declared

• Indirect or consequential losses

• Acts of God, war, strikes, or government actions

10. Insurance

• Insurance is not included unless expressly requested

• Customers are encouraged to arrange cargo insurance

• Carton Couriers & Logistics Services may facilitate insurance at additional cost

11. Force Majeure

Carton Couriers & Logistics Services is not liable for failure or delay caused by events beyond its control, including:

• Natural disasters

• Port closures

• Government actions

• Pandemics

• Civil unrest

12. Indemnification

Customers agree to indemnify and hold the Carton Couriers and Logistics Services harmless from:

• Claims arising from misdeclared goods

• Customs violations

• Third-party claims related to the shipment

13. Right of Lien

Carton Couriers & Logistics Services has the right to:

• Retain possession of goods until all charges are paid

• Sell goods to recover unpaid charges

14. Termination of Services

Carton Couriers & Logistics Services may suspend or terminate services if:

• Terms are breached

• Payment is not made

• Goods are illegal or dangerous

15. Governing Law and Jurisdiction

• These Terms are governed by the laws of Jamaica

• Disputes shall be resolved in the courts of Jamaica

16. Amendments

• Carton Couriers & Logistics Services may amend these Terms at any time

• Updated Terms will be posted or made available to customers

17. Acceptance of Terms

By using Carton Couriers & Logistics Services , the customer:

• Acknowledges having read and hereby agrees to be bound by these Terms and Conditions
